On October 20, 2026, Governor Patrick Morrisey declared a 60-day state of emergency in all 55 counties because diesel prices are high and supply is limited.
He also signed
Executive Order No. 2-26 which gives temporary relief for using red-dyed diesel fuel in highway vehicles.
For conduct on or after October 20, 2026 the State Tax Division will not do any of the following: Assess civil penalties, issue citations, make arrests, seize fuel or vehicles, or refer anyone for prosecution for selling, storing, dispensing or using dyed diesel fuel in a highway vehicle.
The Tax Division will post more guidance on this page soon, including how the motor fuel excise tax applies to dyed diesel used on the highway during the emergency.
